৪২৯ ভুয়া গার্মেন্টসের বিষয়ে ৭ দিনের মধ্যে সিদ্ধান্ত নিতে এফবিসিসিআইকে হাইকোর্টের নির্দেশ
৪২৯টি ভুয়া গার্মেন্টস কারখানার বিষয়ে সিদ্ধান্ত নিতে ব্যবসায়ীদের শীর্ষ সংগঠন এফবিসিসিআইকে নির্দেশ দিয়েছেন হাইকোর্ট। সংগঠনটিকে এক সপ্তাহ সময় দিয়েছেন আদালত। এছাড়া ভুয়া কারখানাগুলোকে বিজিএমইএ’র ভোটার হিসেবে কেন অবৈধ ঘোষণা করা হবে না তাও জানতে চাওয়া হয়েছে। পাশাপাশি অভিযুক্ত কারখানাগুলোর ট্যাক্স আইডেন্টিফিকেশন নম্বর (টিআইএন) ঠিক আছে কি না তা যাচাইয়ে জাতীয় রাজস্ব বোর্ডকে (এনবিআর) সহায়তা করার জন্যও বলেছে হাইকোর্ট।
সোমবার (১২ ফেব্রুয়ারি) গার্মেন্টস মালিক ফয়সাল সামাদের করা এক রিট আবেদনে বিচারপতি নাইমা হায়দার এবং বিচারপতি কাজী জিনাত হকের দ্বৈত বেঞ্চ এ আদেশ দেন।
রিটের পক্ষে আদালতে শুনানি করেন ব্যারিস্টার মুস্তাফিজুর রহমান খান। তিনি বলেন, বিজিএমইএর সদস্য হতে হলে অবশ্যই সংশ্লিষ্ট কারখানার টিআইএন নম্বর থাকতে হবে। রিটার্নও হালনাগাদ থাকতে হবে। যেসব কারখানার বিরুদ্ধে অভিযোগ করা হয়েছে সেগুলোর কারও কারও হয়তো কারখানা ছিল। তাদের অনেকে নানা কারণে ব্যবসার বাইরে আছেন।
তিনি জানান, যেসব কারখানার বিরুদ্ধে অভিযোগ করা হয়েছে সেগুলো থেকে ৭০ থেকে ৮০ জনের নাম বিজিএমইএ নির্বাচনের জন্য গঠিত ট্রাইব্যুনাল বাদ দিয়েছে। এরপর সংক্ষুব্ধ হয়ে রিটকারী এফবিসিসিআইয়ের ট্রাইব্যুনালে আপিল করেছেন। কিন্তু সেখানে তারা আপিল নিষ্পত্তিতে দেরি করছেন। এজন্যই রিট করা হয়েছে। রিটের পরিপ্রেক্ষিতে আদালত আজ এ রায় দিলেন।
এ আইনজীবী জানান, বিজিএমইএ বাংলাদেশের বৃহত্তম বাণিজ্যিক সংগঠন। এ সংগঠনের নির্বাহী কমিটিতে যারা যাবেন তারা যেন বৈধ ভোটার দিয়ে নেতা নির্বাচিত হতে পারেন সেজন্য আদালত এ আদেশ দিয়েছেন।
আগামী ৯ মার্চ তৈরি পোশাক শিল্প মালিকদের সংগঠন বিজিএমইএ’র নির্বাচন হওয়ার কথা। নির্বাচনের তফশিল অনুযায়ী সংগঠনের পক্ষ থেকে ভোটার তালিকা তৈরি করা হয়। সে তালিকায় থাকা কয়েকজনের বিষয়ে সন্দেহ হলে ঘটনা সবার সামনে আসে।
এর আগে ৪২৯টি প্রতিষ্ঠানের নামে টিআইএন আছে কিনা তা পরীক্ষা করে নির্বাচনে অংশ নেওয়া একটি পক্ষ। তাদের অভিযোগ, সদ্য প্রকাশিত প্রাথমিক ভোটার তালিকায় থাকা ৪২৯ জনের কর প্রদানের তথ্য এনবিআরের ওয়েবসাইটে পাওয়া যায়নি। সম্প্রতি সংগঠনের নির্বাচন আপিল বোর্ডের চেয়ারম্যান বরাবর ওই ভোটারদের নাম ও করদাতা শনাক্তকরণ নম্বর (টিআইএন) সম্বলিত একটি তালিকাসহ আপত্তিপত্র দেওয়া হয়।
উল্লেখ্য, ৪২৯টি ভুয়া তৈরি পোশাক কারখানার অস্তিত্ব নিয়ে সম্প্রতি গণমাধ্যমে রিপোর্ট প্রকাশিত হয়। ইতিমধ্যে ৬৭টি ফ্যাক্টরির নাম ওই নির্বাচনের ভোটার তালিকা থেকে বাদ দিয়েছেন নির্বাচনী আপিল বোর্ড। তবে বাকি কারখানাগুলোর নাম বাদ দেয়ার জন্য এফবিসিসিআইয়ের নির্বাচনী ট্রাইব্যুনালের কাছে আবেদন করেছে একটি পক্ষ।
এফবিসিসিআই আরবিট্রেশন ট্রাইব্যুনালে গত ৩১ জানুয়ারি ভুয়া ভোটারের বিষয়ে আবেদন জমা দেওয়া হয়। তবে এখন পর্যন্ত তা শুনানির জন্য আসেনি। এ বিষয়ে গত ৫ ফেব্রুয়ারি ট্রাইব্যুনালের মহাসচিব বরাবর একটি তাগাদাপত্র পাঠানো হয়। এরপরও এ নিয়ে কোনও শুনানি হয়নি। এমনকি এ বিষয়ে ব্যবস্থা আদৌ নেওয়া হবে কি না সে বিষয়েও অভিযোগকারীকে কিছু জানানো হয়নি।
